Introduction
The terms (Trading Terms) outlined herein apply to all transactions made through the Site. Ordering any product or service from our Site indicates your acceptance and acknowledgment to be bound by our Trading Terms. The Trading Terms constitute a legal agreement between the customer and The Collective Concept and cannot be amended or altered without our consent.
We reserve the right to amend our Trading Terms at our discretion, without providing prior notice, provided the updates will not impact any orders made prior to us implementing the change.
Orders
All orders placed through The Collective Concept or its affiliates are subject acceptance and fulfillment. The Collective Concept may cancel or deny any order, at any time and for any or no reason, regardless of whether the order has been confirmed. Should you be charged for an order The Collective Concept later cancels, the order will be refunded.
Pricing
All prices listed for products on our Site are in US Dollars ($), exclusive of applicable State and/or Local Sales tax and shipping costs, unless explicitly mentioned as included within the purchase price. Applicable tax and shipping charges will be included in the total amount due upon your review and submission of your order. We reserve the right to update our pricing at any time prior to your final review and submission of the order. No orders will be accepted until such time that the total amount due is paid in full. Should the price of an item be listed in error, we will attempt to contact you via email and phone to confirm you’d like to proceed with your purchase at the correct price. If you choose not to move forward with your purchase, of if we are unable to reach you by the contact information you’ve provided, the order will be cancelled. Until such time that your product has shipped, we are under no obligation to provide our products at incorrect pricing.
Shipping
All orders will be shipped subject to availability. All shipping is performed by third party carriers, including but not limited to the United States Postal Service (USPS), United Parcel Service (UPS) and FedEx, and delivered to the shipping address provided in your order. Delivery estimates are subject to change at the behest of our shipping partners. Shipping partners may or may not require your signature upon delivery to confirm receipt. Upon receipt of your order, you assume full responsibility and ownership, provided the product arrives undamaged, and acknowledge The Collective Concept bears no liability for the product’s loss or damage once delivered.
Cancellations
You may cancel your order at any time, for any reason, while we are processing your order. Should you cancel the order, your card will not be charged. Once your order is preparing for shipment, you will no longer be able to cancel the order and your card will be charged for the purchase upon shipment.
Returns
The Collective Concept will accept returns up to fourteen (14) days from the confirmed delivery date, provided the product has not been opened or damaged in any way, and a refund will be provided. We reserve the right to require evidence of your order’s condition before accepting the return. In the event you request a return, you are solely responsible for shipping materials to return the item. If an item is delivered defective or damaged, we may offer an exchange, refund or repair, as we deem appropriate and in accordance with applicable federal, state and local statutes. We do not accept returns from shipping locations outside of the United States.
Product Information
We do our best to accurately display colors and details of products offered on our Site, however, it’s important to note the actual colors and details seen depends on the method in which you view our Site and we cannot guarantee your display will accurately reflect the true colors and details of the product. Product details and dimensions on the Site are provided to us by the manufacturer and are meant as a guide only. If you are concerned about the size or details of a particular product, we encourage you to contact the manufacturer directly.
Security
All transactions made through the Site use a secure server connection (https) to protect your personal and financial information. Private information related to your order is encrypted while being passed to our servers. We do not allow orders to be placed outside of a secure connection. We highly encourage customers not to provide payment details to us or any third party by email. Any losses incurred by communicating personal or financial information outside of our secure connection is your full responsibility.
Liability
The Collective Concept is not liable for any loss or damage where adequately performing our obligations are prevented, restricted or denied by causes reasonably beyond our control. You are solely responsible for the use of our products as intended and to the extent your use is not prohibited by law. We accept no liability for losses incurred that are not reasonably foreseeable or from use of our products conflicting with applicable laws or in manners otherwise not used as intended.
General
Non-enforcement of any right does not constitute a waiver of such right. Rights available to you as the purchaser under these Trading Terms can be transferred or reassigned to other individuals or entities. Should any part of our Trading Terms be deemed unenforceable by law, all other sections are unaffected and remain in full force and effect. By placing an order through the Site, you agree that United States federal, state and local laws apply to these Trading Terms and any dispute arising or related to these Trading Terms will be settled by courts under the jurisdiction of the State of Illinois.
